Regarding paragraph 2.29, the Greens have concerns about the history within some law enforcement agencies of non-compliance with record-keeping requirements for telecommunications intercepts and other secretly obtained information. This includes failing to properly store, protect and destroy sensitive data.
While there is an intention for these powers to be used in strictly limited circumstances relating to serious threats to life, the possibility of the powers being used for broader law enforcement powers is real and will require ongoing oversight to prevent mission creep.
Regarding paragraph 2.66, the Greens share concerns about the lack of remedy for breaches of privacy under this scheme, and the inadequacy of other existing remedies at law. We recognise this is an area where future law reform is required.
