On 7 December 2017, the Senate, pursuant to a recommendation of the Selection of Bills Committee, referred the Judiciary Amendment (Commonwealth Model Litigant Obligations) Bill 2017 to the Legal and Constitutional Affairs Legislation Committee for inquiry and report by 8 May 2018.

The Senate has agreed to extend this reporting date on two occasions. On 8 May 2018, the Senate agreed to extend the committee's reporting date to 28 June 2018. On 26 June 2018, the Senate agreed to extend the committee's reporting date to 27 July 2018.

To date, the committee has accepted 25 submissions. It also held a public hearing in Sydney on 14 June 2018.

The committee seeks an extension of the reporting date to 19 September 2018 to enable it to further consider the evidence and conclude its deliberations.
