Tax Laws Amendment (2012 Measures No. 3) Bill 2012 and related bills

Information about the Inquiry

Pursuant to a resolution of the Senate on 9 May 2012 regarding the consideration of time critical bills, the provisions of the following bills were referred on 24 May 2012 to the Senate Economics Legislation Committee for inquiry and report:

- Tax Laws Amendment (2012 Measures No. 3) Bill 2012;
- Income Tax (Seasonal Labour Mobility Program Withholding Tax) Bill 2012; and
- Tax Laws Amendment (Income Tax Rates) Bill 2012.

The bills make amendments to various taxation laws to:

- create a new final withholding tax regime that applies to income derived by non-resident workers participating in the Seasonal Labour Mobility Program;
- make further consequential arrangements to the taxation of blends of gaseous and aviation fuels;
- clarify that trust beneficiaries who are minors cannot receive the benefit of the low income tax offset for unearned income acquired through trust distributions;
- exempt clean energy payments made to recipients of payments under various income support programs (the ABSTUDY scheme, Veterans' Children Education Scheme, Military Rehabilitation and Compensation Act Education and Training Scheme, the transitional family farm payment and exceptional circumstances relief payment).
- amend arrangements for the employer termination payment tax offset; and
- align the non-resident tax rates more closely with the personal income tax rates for Australian resident taxpayers.

Submissions should be received by 5 June 2012. The reporting date is 18 June 2012.
