The Parliamentary Joint Committee on Intelligence and Security is required under paragraph 29(1)(ca) of the Intelligence Services Act 2001, to commence, by the third anniversary of the day the Australian Citizenship Amendment (Citizenship Cessation) Act 2020 commenced, a review of the operation, effectiveness and implications of Subdivision C of Division 3 of Part 2 of the Australian Citizenship Act 2007 (citizenship cessation determinations) and any other provision of that Act as far as it relates to that Subdivision.
The Committee commenced the review and called for submissions on 12 September 2023.
The Australian Citizenship Amendment (Citizenship Repudiation) Bill 2023 was introduced into Parliament on 29 November 2023, and became law on 7 December 2023. That Act repealed and replaced the operative provisions of Subdivision C.
On 4 December 2023 the Senate resolved:
That, following the passage of the bill, the following matter be referred to the Parliamentary Joint Committee on Intelligence and Security for inquiry and report by 14 March 2024: The operation, effectiveness and implications of the amendments made by the Australian Citizenship Amendment (Citizenship Repudiation) Bill 2023.
This means that an inquiry stands referred to the Committee that is substantively identical to this Review, and the Committee has therefore decided to combine these reviews and report on them together.
The Committee tabled its report on Thursday 21 March 2024.
