Australian Greens additional comments

The Australian Greens have concerns about the current annual reporting of Orders and believe reporting needs more qualitative information that contains suitable and appropriate disaggregated data, to increase transparency and provide further context and scope in the use of this agreement.
The Australian Greens believe that independent authorities should be removed from the agreement. Orders should always be subject to a review or oversight as per domestic law of the issuing party by a court, judge, or magistrate, prior to or in proceedings regarding enforcement of the Order.
The Australian Greens believe the maximum term of imprisonment should be increased to seven years. The current definition of serious crime holds a maximum term of at least three years imprisonment which can be adequately covered under the existing mutual legal assistance treaty.
The Australian Greens believe that solid reporting, strict and enforceable repercussions, and clear implementation requirements are essential in the success of this agreement.
