Recommendation

The Committee recommends that section 127 of the ASC Act should be reviewed: to remove any ambiguity which may prevent the ASC from exchanging information with a foreign regulator or exchange; and to ensure that, when deciding to provide information in situations of market crisis, the ASC is able to consider both the public interest in the fair conduct of business and the individual's right to be treated fairly.
