Review of the Migration Amendment (Clarifying International Obligations for Removal) Act 2021

The Parliamentary Joint Committee on Intelligence and Security has commenced a review into amendments made to the Migration Act 1958 (Migration Act) by Schedule 1 of the Migration Amendment (Clarifying International Obligations for Removal) Act 2021 (CIOR Act).

Schedule 1 of the CIOR Act amended provisions of the Migration Act relating to protection visas. The amendments aimed to clarify that the Migration Act does not authorise the removal of a person who is found to attract Australia’s protection obligations under international law; and to require that Australia’s protection obligations be considered before a decision is made to grant or refuse a protection visa.

Paragraph 29(1)(cf) of the Intelligence Services Act 2001 requires the Committee to commence a review of the operation, effectiveness and implications of the amendments made by Schedule 1 of the CIOR Act, by the second anniversary of the commencement of the CIOR Act.
