Recommendation 1
1.77The committee recommends that the Senate adopt the following resolution requiring the production of documents:
That the Senate orders that there be provided to the Senate Economics References Committee by the Minister representing the Treasurer, by no later than midday on Tuesday, 18 July 2023:
oIn the event that the order is not complied with in full by the due date, the Senate requires that the Minister representing the Treasurer attend the Senate on Wednesday, 2 August 2023 at the conclusion of motions to take note of answers, to provide an explanation of the failure to comply with the order, and that:
any senator may move to take note of the explanation; and
any such motion may be debated for no longer than 90 minutes, shall have precedence over all other business until determined, and senators may speak to the motion for not more than 10 minutes each.
Recommendation 2
1.94The committee recommends that the Senate adopt the following resolution requiring the production of documents:
That the Senate orders that there be provided to the Senate Economics References Committee by the Minister representing the Treasurer, by no later than midday on Tuesday, 18 July 2023:
-the answers that provide the information sought by the questions listed in Table 1.4 of the report of the Senate Economics References Committee on its inquiry into the capacity and capability of the Australian Securities and Investments Commission (ASIC) to undertake proportionate investigation and enforcement action arising from reports of alleged misconduct.
-That on Wednesday, 19 July 2023 the Economics References Committee report to the Senate whether the documents have been provided to the committee in accordance with paragraph (1).
-In the event that the order is not complied with in full by the due date, the Senate requires that the Minister representing the Treasurer on attend the Senate on Wednesday, 2August2023 at the conclusion of motions to take note of answers, to provide an explanation of the failure to comply with the order, and that:
any senator may move to take note of the explanation; and
any such motion may be debated for no longer than 90 minutes, shall have precedence over all other business until determined, and senators may speak to the motion for not more than 10 minutes each.
