C. Glossary

Adverse Security Assessment – has the meaning given by section 35 of the Australian Security Intelligence Organisation Act 1979:
security assessment means a statement in writing furnished by ASIO to a Commonwealth agency expressing any recommendation, opinion or advice on, or otherwise referring to, the question whether it would be consistent with the requirements of security for prescribed administrative action to be taken in respect of a person or the question whether the requirements of security make it necessary or desirable for prescribed administrative action to be taken in respect of a person, and includes any qualification or comment expressed in connection with any such recommendation, opinion or advice, being a qualification or comment that relates or that could relate to that question.
adverse security assessment means a security assessment in respect of a person that contains:
any opinion or advice, or any qualification of any opinion or advice, or any information, that is or could be prejudicial to the interests of the person; and
a recommendation that prescribed administrative action be taken or not be taken in respect of the person, being a recommendation the implementation of which would be prejudicial to the interests of the person.
Carriage service – has the meaning given by section 7 of the Telecommunications Act 1997:
A service for carrying communications by means of guided and/or unguided electromagnetic energy.
Carriage services include services for carrying communications, for example telephone services, internet access services and Voice over Internet Protocol (VoIP) services.1
Carriage service intermediary – means a person who is a carriage service provider under subsection 87(5) of the Telecommunications Act 1997:
Arranges, or proposes to arrange, for the supply of a listed carriage service by a carriage service provider to a third person.
To summarise, carriage service intermediaries are middle persons that act between carriage service providers and customers to arrange supply of a service for reward.2
Carriage service provider3 – has the meaning given by section 87 of the Telecommunications Act 1997:
Supplies or proposes to supply listed services to the public using network units owned by a carrier or through units covered under a Nominated Carrier Declaration.
To summarise, carriage service providers are those industry participants who use a carrier’s network to provide telecommunications services to the public.4
Carrier – has the meaning given by section 7 of the Telecommunications Act 1997:
The holder of a carrier license granted by the Australian Communications and Media Authority under section 56 of the Telecommunications Act 1997.
To summarise, carriers own telecommunications network infrastructure and provide basic transmission on which carriage and content services are supplied to the public.
Communications Access Co-ordinator – has the meaning given by section 6R of the Telecommunications (Interception and Access) Act 1979:
The Secretary of the Attorney-General’s Department, or
A person or body specified by the Minister in a legislative instrument.
Competent supervision – as defined in the Explanatory Memorandum:
The ability of a carrier or carriage service provider (C/CSP) to maintain proficient oversight of its networks and facilities. This could include maintaining the visibility of operations, key data flows and locations, awareness of parties with access to network infrastructure and the ability to detect security breaches or compromises.5
Effective control – as defined in the Explanatory Memorandum:
The ability of a C/CSP to maintain direct authority and/or contractual arrangements to ensure the protection of its networks and facilities, and the information that is stored or transmitted across them. This would include authority over all parties with access to network infrastructure and data. It could include the ability to terminate contracts where a security breach is attributable to the contracted services or equipment, directing contractors to carry out mitigation or remedial actions, and obliging contractors to monitor and report breaches to the C/CSP.6
Facility – has the meaning given under section 7 of the Telecommunications Act 1997:
(a)
Any part of the infrastructure of a telecommunications network, or
(b)
Any line, equipment, apparatus, tower, mast, antenna, tunnel, duct, hole, pit, pole or other structure or thing used, or for use, in or in connection with a telecommunications network.
Intermediary – see Carriage Service Intermediary.
Nominated carriage service provider (NCSP) – means a carriage service provider covered by a declaration in force under subsection 197(4) of the Telecommunications (Interception and Access) Act 1979.
Telecommunications network – has the meaning given under section 7 of the Telecommunications Act 1997:
A system, or series of systems, that carries, or is capable of carrying, communications by means of guided and/or unguided electromagnetic energy.
Telecommunications Sector Security Reforms – a general term used to describe the reforms set out in the Telecommunications and Other Legislation Amendment Bill 2016.
