The Parliamentary Joint Committee on Intelligence and Security (PJCIS) will hold a public hearing for its Review of post-sentence terrorism orders: Division 105A of the Criminal Code Act 1995 (Criminal Code) this week. Government and non-government representatives will discuss post-sentence terrorism orders, including continuing detention orders and extended supervision orders. The PJCIS statutory review follows the publication of a Review into Division 105A (and related provisions) of the Criminal Code Act 1995 (Cth) by the Independent National Security Legislation Monitor (INSLM), Mr Grant Donaldson, in March 2023. Committee Chair, Mr Peter Khalil MP, said ‘The Committee has received mixed evidence regarding the operation and implications of post-sentence orders. The Parliamentary Joint Committee on Intelligence and Security (PJCIS) has commenced a review of the operation, effectiveness and implications of post-sentence terrorism orders, provided for in Division 105A of the Criminal Code Act 1995 (Criminal Code). Division 105A provides for two types of post-sentence orders: continuing detention orders (CDOs) and extended supervision orders (ESOs). These may be made in respect to individuals currently serving a sentence for a serious terrorism offence, when a Court considers they pose an ‘unacceptable’ risk to society of committing another serious terrorism offence if they are released into the community without restriction. The Committee’s review is required by law, and follows the publication of a Review into Division 105A (and related provisions) of the Criminal Code Act 1995 (Cth) by the Independent National Security Legislation Monitor (INSLM), Mr Grant Donaldson. Chair of the Committee, Mr Peter Khalil MP, said that ‘The PJCIS has taken note of Mr Donaldson’s review, and the Committee is also conscious that post-sentence orders are likely to be increasingly considered over the next five years, with 20 of 54 individuals currently in detention for serious terrorism offences due to be released in that period. This makes both the INSLM’s and the Committee’s reviews particularly timely. Both reviews will contribute to necessary consideration by the Parliament and Government of the continued effectiveness and appropriateness of the post-sentence orders regime.’ Additional information on the Committee’s review is available here.
