DELEGATED LEGISLATION MONITOR

This week there were 100 disallowable instruments of delegated legislation tabled in the Senate, made under 61 separate enabling Acts administered through 16 Departments of State.

Of the 100 instruments, 63 are from the Statutory Rules series of delegated legislation, which are generally superior in drafting, presentation and access to other forms of delegated legislation. This proportion of Statutory Rules in the total number is usual, illustrating the long term trend towards the greater use of instruments in series other than the Statutory Rules. Of the 100 instruments, 69 were made by the Governor-General or Ministers and 31 were made by public officials. Of the 63 sets of Statutory Rules, 16 were made as principal instruments and 47 as amending instruments.

The Trade Practices (Industry Codes – Franchising) Regulations 1998, Statutory Rules 1998 No.162, prescribe the Franchising Code of Conduct as a mandatory industry code. The Explanatory Statement advises that the operation of the franchising sector has been of government concern for many years, with many problems and high dispute levels. The code, which will be administered by the Australian Competition and Consumer Commission, aims to provide protection for all franchisees through minimum standards disclosure and conduct.

The Kakadu National Park Plan of Management sets out how the Park will be managed, including sections on decision making, tourism, administration and research. As far as possible the Plan has been written using plain language so that it is easier to read for people who are not experienced in the use of formal English. The enabling provisions of the National Parks and Wildlife Conservation Act 1975, under which the Plan was made, are unusual in that they provide for public consultation and submissions before a Plan is made.

The Income Tax Regulations (Amendment), Statutory Rules 1998 No.163, make it possible for a taxpayer to benefit through the PAYE system from an expected entitlement to the savings tax offset, by reducing the amount of tax instalment deduction in respect of wages and salaries paid by an employer. These taxpayers elect to have the offset available by completing a declaration.

A number of instruments implement changes consequent upon recent finance section legislation, under which the Insurance and Superannuation Commissioner was abolished; the Australian Prudential Regulation Authority established; and the role of the Australian Securities Commission, renamed the Australian Securities and Investments Commission, enlarged to oversee consumer protection and market integrity in the financial sector.

The Retirement Savings Accounts Regulations (Amendment), Statutory Rules 1998 No.176, introduce a new system of preserving superannuation benefits in RSA, which will improve and simplify the preservation rules. The Regulations also increase gradually the superannuation preservation age, now 55 years, from 2015, so that by 2024 it will be 60 years.
