DELEGATED LEGISLATION MONITOR

This week there were 170 disallowable instruments of delegated legislation tabled in the Senate, made under 41 separate enabling Acts administered through 14 Departments of State.

Of the 170 instruments, 27 are from the Statutory Rules series of delegated legislation, which are generally superior in drafting, presentation and access to other forms of delegated legislation. This proportion of Statutory Rules in the total number is usual, illustrating the long term trend towards the greater use of instruments in series other than the Statutory Rules. Of the 170 instruments, 37 were made by the Governor-General or Ministers and 133 were made by public officials. Of the 27 sets of Statutory Rules, four were made as principal instruments and 23 as amending instruments.

The Child Care (Eligibility – New Allocations) Guidelines 1998 and the Child Care (High Needs Regions) Determination 1998 are intended to address the problem that has arisen from some areas being over supplied with private centre-based long day care while other communities have few or no child care services.

The Health Insurance Commission Regulations (Amendment), Statutory Rules 1998 No.67, implement details of a new eligibility criterion for the Commonwealth Childcare Rebate which requires some children to be fully immunised for their family to be eligible to claim the rebate.

The Private Patients’ Hospital Charter sets out what contributors to health funds may reasonably require from registered organisations, medical practitioners, hospitals and day hospital facilities and advises people of matters to consider in making decisions about becoming contributors to such funds.

The Remuneration Tribunal Determination No.12 of 1998 determines, among other things, remuneration for the President of the Human Rights and Equal Opportunity Commission, for the Executive Director of the Australian Sports Commission and for the Chief Executive Officers of the Australian National Training Authority and the Australia New Zealand Food Authority.

The High Court Rules (Amendment), Statutory Rules 1998 No.61, made by the seven justices of the High Court, increase the amounts which solicitors may charge in respect of proceedings in the Court.

The AUSTUDY Regulations (Amendment), Statutory Rules 1998 No.71, implement benefits available to eligible farmers in declared exceptional circumstances and a welfare safety net for certain low income farmers experiencing financial hardship.

The Customs (Prohibited Imports) Regulations (Amendment), Statutory Rules 1998 No.58, correct inadvertent effects on the importation of certain firearms for official purposes and by international and Olympic competitors. They also lift unreasonable burdens on firearms dealers and Customs officials.
