Index of Disallowable Instruments of Delegated Legislation Tabled in the Senate in 1998

FOREWORD

This Delegated Legislation Monitor is a consolidated edition of all of the weekly Monitors which are produced in respect of each sitting week of the Senate during the calendar year. The format of the consolidation is similar to that of the weekly Monitors, setting out details of every disallowable instrument of delegated legislation tabled in the Senate. These details include the enabling Act under which each instrument was made, the date it was made, the date of tabling in the Senate and House of Representatives, the Department of State through which the Minister administers the enabling Act, and a short summary of its subject matter.

During 1998 a total of 1750 disallowable instruments were tabled in the Senate, 30 more than the 1720 tabled in 1997. These instruments were made under the authority of 215 separate enabling Acts, administered by 17 Departments of State. By far the largest number of instruments - 535 - were made under the Civil Aviation Act 1988. Large numbers of instruments were also made under the Public Service Act 1922, with 188 instruments, the Veterans' Entitlements Act 1986, with 89 instruments, the Customs Act 1901, with 81 instruments, the Defence Act 1903, with 51 instruments, and the National Health Act 1953, with 38 instruments.

Of the instruments tabled during 1998 only 429, or some 24%, were in the Statutory Rules Series, which are generally superior in drafting, presentation and access in comparison to other series of instruments.

Most instruments were made under a single enabling Act. However, numbers of instruments were made under more than one Act – 37 were made under two enabling Acts, 15 under three enabling Acts, three under four enabling Acts, one under five enabling Acts and one under eight enabling Acts. The majority of the instruments made under more than one Act provided for primary industry matters.
