Summary
Amends the Copyright Act 1968 in relation to Australia’s obligations under the Australia-United States Free Trade Agreement by: broadening and clarifying the scope of certain criminal offences; clarifying criminal and civil presumptions; narrowing the scope of the exception to the reproduction right; clarifying provisions that limit the remedies available against carriage service providers; and inserting a new offence relating to the unauthorised use of an encoded broadcast for commercial purposes; and contains application provisions. Also amends the US Free Trade Agreement Implementation Act 2004 to place a time limit on the application of transitional provisions relating to the extension of the term of copyright protection.
