Summary
Amends the Health and Other Services (Compensation) Act 1995 to: repeal the sunset clause (due to take effect on 1 July 2006) to enable the continuation of the Advanced Payment Option for compensation claimants to access the major proportion of compensation money at the time of their judgement or settlement; remove the definition of “fatal injury” to ensure that Commonwealth benefits paid in situations involving a fatal injury or disease must also be repaid after judgement or settlement; provide a formal pathway for review of certain decisions; replace certain superseded wording; and clarify the value of a “small amount”.
