  Introduced with the Foreign Acquisitions and Takeovers Fees Imposition Amendment Bill 2020, the bill amends the:

  Foreign Acquisitions and Takeovers Act 1975

  to: introduce a new national security test which requires mandatory notification of investments in a sensitive national security business or land and allows investments not otherwise notified to be 'called in' for review on national security grounds; provide the Treasurer, as a last resort and in extraordinary circumstances, with the ability to issue a divestment order where there is no other remedy for a national security risk; expand the enforcement, monitoring and investigative powers of the Treasurer and the Commissioner of Taxation; amend the circumstances in which an investor satisfies the change in control test; deems a foreign person to have acquired an interest in securities in an entity where the persons' proportional holdings have increased without the person taking any action; amend the definition of Australian business to include state and territory business functions; expand the tracing rules to unincorporated limited partnerships; enable information sharing with foreign governments; create a Register of Foreign Ownership of Australian Assets which incorporates the existing Register of Foreign Ownership of Water Entitlements and Register of Foreign Ownership of Agricultural Land, and create additional obligations to notify the Registrar of a broader range of interests; provide that fees are payable for new types of actions; and make consequential and technical amendments;

  Taxation Administration Act 1953

  to enable the Commissioner of Taxation to disclose protected information to the Foreign Investment Review Board for certain purposes; and

  Foreign Influence Transparency Scheme Act 2018

  (FITS Act) to require the secretary to continue to publish certain information about registered persons after they cease to be registered, including information that was published about that person before their registration ceased; and

  National Security Legislation Amendment (Espionage and Foreign Interference) Act 2018

  to: provide that people who are liable to register under the FITS Act will be required to register within three months of the FITS Act commencing; and provide that, if election writs for either House of Parliament are issued before the end of that three month period, such persons will have to register no later than 14 days after the issuing of the writs.

  Introduced with the Foreign Influence Transparency Scheme (Charges Imposition) Bill 2017, the bill establishes the Foreign Influence Transparency Scheme to: require registration by certain persons undertaking certain activities on behalf of a foreign principal; require registrants to disclose information about the nature of their relationship with the foreign principal and activities undertaken pursuant to that relationship; place additional disclosure requirements on registrants during elections and other voting periods; establish a register of scheme information and provide for certain information to be made publicly available; provide the secretary with powers to obtain information and documents; and establish various penalties for non-compliance with the scheme.

  to: amend the definition of 'communication activity' to capture a person that produces information or material on behalf of a foreign principal for the purpose of the information or material being distributed to the public; provide that a person's belief about the intention of a foreign principal may be taken into account when determining the purpose of an activity; provide that the reporting obligations under the foreign influence transparency scheme apply to persons that are liable to register, but who have not yet actually registered; extend the obligation to make disclosures in registrable communications activity to any person who undertakes a registrable communication activity on behalf of a foreign principal (not just to those who are already registered); and make technical amendments to certain offence provisions.
