Inquiry into the Family Law Amendment (Federal Family Violence Orders) Bill 2021 [Provisions]

On 13 May 2021, the Senate referred the provisions of the Family Law Amendment (Federal Family Violence Orders) Bill 2021 to the Legal and Constitutional Affairs Legislation Committee for inquiry and report by 29 July 2021.

The deadline for submissions to this inquiry is 18 June 2021.

Submitters should read and consider the bill carefully and provide a submission that directly addresses the bill. You should also carefully consider the appropriateness of providing personal information and documents, such as names, birthdates, details of legal proceedings and/or copies of legal documents.

It is not the role of the committee to resolve or arbitrate individual matters.

The committee may decide not to accept or not to publish material that includes personal information and/or documents, that is not relevant to the bill, or which reflects adversely on others.

About this inquiry

The bill would amend the Family Law Act 1975 to establish new federal family violence orders which, if breached, could be criminally enforced. The bill would allow a listed court to make a federal family violence order where the court is satisfied that a person has been or there are reasonable grounds to suspect that it is likely that they will be subjected to family violence or, in the case of children, the child has been or there are reasonable grounds to suspect that it is likely that they will be subjected or exposed to family violence.
