The Joint Standing Committee on Electoral Matters has commenced an inquiry into civics education, engagement, and participation in Australia, and is seeking written submissions in response to the Terms of Reference by Friday 24 May 2024. The Committee is particularly interested in hearing from people with direct experience of civics and citizenship education and challenges associated with electoral participation. This includes students and teachers, young people, First Nations peoples, people from culturally and linguistically diverse (CALD) backgrounds, civic and educational organisations, and people in regional, rural, and remote areas. Committee Chair, Ms Kate Thwaites MP, said ‘in a time when we’re seeing challenges for democracies across the world, and a rise in mis and disinformation, it’s important that every Australian has the opportunity to be informed about and engaged in our democracy. ‘The Committee wants to hear Australians’ experiences of civics education, and what we can do better to support democratic engagement and participation. ‘So many young Australians are passionate about social and political issues, but they may not have access to relevant and reliable information about democratic and electoral processes. ‘The diversity of cultures, languages, and life experiences within Australia means we need to ensure access to relevant, digestible, and accurate information about our democracy. The Joint Standing Committee on Electoral Matters has concluded its inquiry into the 2022 election, making recommendations for reforms to improve donation transparency, reduce the influence of big money, and strengthen trust and participation in our elections. The Committee’s final report, tabled today in Parliament, makes 21 recommendations on top of the 15 made in its interim report released in June. Committee Chair Ms Kate Thwaites MP said, ‘Our electoral system is strong, but our democracy is too important to be complacent. The Committee heard clear evidence of the need for reform. ‘Based on the evidence we have received, the Committee has recommended reforms to improve donation transparency, address the electoral ‘arms race’ of increased spending on elections, limit the potentially corrupting influence of big money, and build public trust.’ These include reaffirming recommendations made in the interim report, including: Lowering the donation disclosure threshold to $1,000 and introducing ‘real time’ disclosure; Introducing donation and electoral spending caps; and Introducing truth in political advertising laws. In addition, the Committee’s final report makes further recommendations around representation, participation and other issues, including: Improving representation – increasing Senate representation for the two territories from two to four Senators, and requesting a specific inquiry into increasing the size of the House of Representatives; Encouraging participation and enfranchisement – making voting more accessible, including for Aboriginal and Torres Strait Islander peoples, people with disabilities, older Australians and Australians overseas; and Modernising election campaign legislation, including amending the process for the distribution of postal vote applications. The Joint Standing Committee on Electoral Matters has released its interim report into the 2022 federal election, and has recommended significant reforms to Australia’s electoral system. Committee Chair Ms Kate Thwaites MP said, ‘Australians are rightly proud of our electoral system, but it is important that we continue make sure that it is trusted, relevant and fit for purpose. The evidence we have heard has allowed the Committee to develop clear goals for reform: to increase transparency in election donations and curb the influence of big money, to build the public’s trust in electoral and political processes, and to encourage participation in our elections’. The report makes 15 recommendations, focused on three main topics: political donations and electoral expenditure, truth in political advertising and encouraging Aboriginal and Torres Strait Islander participation in elections. Parliament’s Joint Standing Committee on Electoral Matters is now inviting submissions to the review of the 2022 federal election. The Committee conducts a review of the previous election early in each new Parliament. Committee Chair Kate Thwaites MP (Jagajaga, Vic) said the inquiry is an important part of ensuring that Australia’s democracy remains strong. ‘This review is an important opportunity to examine how things worked during the last election, including areas that could be improved for future elections. It helps to ensure the conduct of our elections is accountable and transparent and supports public confidence in our electoral system and our democracy,’ Ms Thwaites said. The terms of reference for the inquiry include examining proposals to reform laws on political donations, including real time disclosure and a reduction to the disclosure threshold, and potential reforms to election funding. Additionally, the Committee expects to focus on the potential for 'truth in political advertising' laws to enhance the integrity and transparency of the electoral system; and increasing participation of First Nations People; as well as increased electoral participation and enfranchisement generally. Information provided to the Australian Electoral Commission by individuals thinking about standing as a candidate for the Commonwealth Parliament will be reviewed by federal Parliament’s Electoral Matters Committee via a new inquiry into the qualification checklist relating to eligibility 3 under section 44 of the Australian Constitution. The proposed Checklist responds to Recommendation 1 of the Joint Standing Committee on Electoral Matters' Report on the conduct of the 2019 federal election. Committee Chair Senator James McGrath said that ‘although the candidate checklist worked well in the 2019 election, there were some critical elements, such as requiring information on a candidates date and country of birth, that were not required as mandatory data. This information is highly relevant to ascertaining a candidate’s citizenship status.’ ‘It is important to examine the proposed amendments to the Candidate Qualification Checklist and ensure there is adequate time to incorporate any revisions before the next election’, Senator McGrath said. Optional preferential voting, the introduction of the Robson Rotation for House of Representatives ballot papers and an entirely new Electoral Act have all been recommended by the Parliament’s Electoral Matters Committee. Tabling a report into the 2019 Federal Election, Committee Chair Senator James McGrath said Australia’s reputation as a successful democracy was upheld by the delivery of a transparent and robust election outcome. “Australia is one of the oldest most successful democracies in the world,” Senator McGrath said. “But that has not come through chance, or good luck - our democracy works because over a century, generations of people, paid and unpaid, have worked to make it so through blood, sweat and tears. “Our democracy works because countless Australians have made the ultimate sacrifice to protect the freedoms inherent in democracy. “Our elections are a fundamental cornerstone to our democracy and they should not only be fair, open and transparent, they should be seen to be so. “As technology evolves and society changes, we must ensure our electoral processes are robust and voters are empowered. “There is action that can be taken to increase fairness and protect our electoral system. The Committee’s recommendations will empower the voter, increase transparency, establish further safeguards, and create consistency.” The Committee recommended: To maximise voter choice compulsory preferential voting should be replaced by optional preferential voting. To increase fairness and to reduce the luck of the ballot draw while minimising the so-called donkey vote, the Robson Rotation of candidates on the ballot paper should be introduced for the House of Representatives in tandem. Voter ID should be introduced for all voters with savings measures similar to provisional votes. Likewise, all electoral enrolments, whether new or changes should require proof of ID. The pre poll voting period should be reduced from three weeks to a maximum of two weeks. Voters who choose to vote early should be required to explain why they are unable to attend on the day rather than it being a matter of convenience. The Electoral Act should be completely rewritten to make it fit for purpose. A new offence of political violence, both physical and verbal should be introduced. The rules governing the use of Party names should be tightened to restrict the use of existing party names by new political entrants. “Parliament should also commence a conversation about whether the Parliament should be increased in size,” Senator McGrath said. “Part of the dialogue should consider whether the nexus between the Senate and the House of Representatives should be reformed.” “In addition, consideration should be given to changing the term of the House of Representatives from three years to four years.” You can read the full report by clicking here. After two years in operation, a law to improve transparency and accountability around political donations will be reviewed by the Parliament’s Electoral Matters Committee. Committee Chair Senator James McGrath says the review of the Electoral Legislation Amendment (Electoral Funding and Disclosure Reform) Act 2018 is an opportunity for the Parliament to ensure that the law is working as it should. ‘The Committee will also take the opportunity to check in on how the Act’s objectives can continue to be achieved in the most effective way while minimising red tape,’ Senator McGrath said. ‘We are also interested in the impacts of amendments to the original bill that are relevant to charitable issue-based advocacy.’ Senator McGrath noted that the Committee will examine the operation of the amendments, dealing with foreign donations; and the clarity of public guidance products issued by regulators. The impact of natural disasters and COVID-19 in 2020 has affected lives all over Australia, and now the Parliament’s Electoral Matters Committee has launched an inquiry into the future conduct of elections in emergency situations. Committee Chair Senator James McGrath said this year’s COVID-19 pandemic in particular has underscored that emergency situations can and do arise during election periods. ‘From health pandemics to natural disasters, international conflict or civil unrest, we want to find out whether our electoral law and the Australian Electoral Commission are as prepared as possible for unusual events or disruptions in the future’, Senator McGrath said. ‘We have a healthy and secure electoral system but we need to make sure that in all scenarios barriers are identified early and issues worked through before they are needed so that everyone can have their say.’ The Committee would particularly like to hear from constitutional experts; emergency management services; cyber-threat experts; Commonwealth, State and Territory governments and agencies; disability and inclusion advocates; Indigenous peak bodies and voters; and electoral commissions. ‘We’ve seen from the Eden-Monaro by-election, as well as elections in Queensland, the Northern Territory and the Australian Capital Territory, that measures are already being put in place to deal with COVID-19’, Senator McGrath said. ‘I’m very interested in taking the lessons learned from these examples, as well as next month’s state election in Queensland, and seeing how they might apply on a federal level.’ As part of the inquiry, the Committee will examine the short and long term impacts of unexpected, rapidly developing external events that could substantially interrupt normal voting, election administration or campaigning, including contingency plans for an increased demand in alternative voting options. The Electoral Matters Committee has commenced a review into the Commonwealth Electoral Amendment (Ensuring Fair Representation of the Northern Territory) Bill 2020. The bill, introduced to the Senate by Senator Malarndirri McCarthy and Senator the Hon Don Farrell, would amend the Commonwealth Electoral Act to provide for a minimum of two divisions for the Northern Territory in the House of Representatives. Analysis from the Parliamentary Library has projected the possibility of the Northern Territory losing one of its two House of Representatives seats before the next federal election, caused by its population falling below the entitlement quota for the second seat. Australians’ capacity to determine credible information from fake content propagated by foreign actors on the internet will be discussed at a public hearing tomorrow. Experts from the University of Canberra will share their findings with the Joint Standing Committee on Electoral Matters as part of the inquiry into the 2019 Federal election. The News & Media Research Centre submitted to the Committee that compared to sophisticated weapons systems, the requirements for influence campaigns are minimal. ‘Unlike the technical hurdles involved in missile defence or nuclear weapons, influence operations can be carried out using a computer screen and an internet connection…’ the submission said. Committee Chair Senator James McGrath says foreign interference and misinformation must be combated to protect our democratic institutions. ‘The way we access information is changing. Australians are increasingly turning to digital technology, away from traditional forms of media. Information is more accessible than ever before – and the ways disinformation can be spread is evolving all the time. So the Committee looks forward to hearing how we can better protect our democratic institutions from manipulation as we move further into the digital age,’ Senator McGrath said. It is imperative we have voting options, but we need to examine what impact this increased uptake in pre-poll voting is having’, he said. Senator McGrath said the rise of social media manipulation and disinformation campaigns were a threat to democracy. ‘Increasingly, Australians are consuming and accessing their news online, away from traditional offline sources. We need to ensure our electoral processes take the serious dangers of digital platforms and disinformation into account.’ The Committee is expected to hear from a wide range of individuals and organisations, including the Australian Electoral Commission (AEC). Senator McGrath said, ‘Elections are everybody’s business, so we are not just reviewing the AECs performance. This inquiry is an opportunity to look at all actors who participate in our elections, including third-parties. Committee Chair, Senator James McGrath, said the Committee looks forward to hearing insights from Electoral Commissioner Tom Rogers and his team. ‘The AEC has a big job in delivering effective elections. The world is changing though, and we need to make sure the AEC can keep doing its job well,’ Senator McGrath said. ‘We know that the legislation around elections is highly prescriptive. We also know there are some real logistical challenges for the AEC. Law makers from seven countries have signed a declaration in Dublin to advance international collaboration in the regulation of social media to combat harmful content, hate speech and electoral interference online.

  Earlier this month, members of the Electoral Matters Committee travelled to Northern Ireland to participate in a meeting of the Grand International Committee on Disinformation and ‘Fake News’. This committee is comprised of the members of several parliamentary committees around the world, in recognition of the potential global impact that can be caused by disinformation and ‘fake news’. Below is a media release published by the International Grand Committee on 7 November 2019.   Law makers from seven countries have signed a declaration in Dublin to advance international collaboration in the regulation of social media to combat harmful content, hate speech and electoral interference online. Members of the International Grand Committee on Disinformation and ‘Fake News’ signed the agreed principles in Leinster House, this evening at the end of a day long meeting in the Seanad Chamber. Chair of the International Grand Committee (ICG), Hildegarde Naughton TD said: “The message from the International Grand Committee is clear; self-regulation by global technology firms is not sufficient. “The principles agreed and signed today are a clear message that the social media landscape needs to change to boost transparency and protect democratic elections. There is a need for full transparency regarding the source, methods of targeting and funding for all on-line political advertising. As the internet is a global network the response to combat harmful content online must be an international collaboration.” The ICG is a gathering of parliamentarians who meet to discuss the behaviour and regulation of social media platforms. The ICG met for the first time in Westminster at the end of 2019 and in Ottawa in May 2019. Deputy Naughton signed the declaration along with parliamentarians from six countries: Australia, Finland, Estonia, Singapore, UK and the USA. Deputy Naughton said: “It has been an honour to chair this meeting of the International Committee on Disinformation and ‘Fake News’ in the Seanad Chamber. This is the third meeting of the International Grand Committee and it’s significant that the declaration is signed here in Dublin which is the home to the European headquarters of social media companies like Twitter and Facebook. “All of our signatories leave here today having agreed to support or introduce legislation in their own parliaments to require disclosure and transparency of online political advertising while at the same time respecting free speech. There is an understanding that free speech also requires transparency of source and adherence to national laws.” International Grand Committee Members agreed the following set of principles in the interest of advancing international collaboration in the regulation of harmful content, hate speech and electoral interference online: Online harmful content and disinformation are complex problems which require political and civic collaboration to combat; left unchecked, these problems will undermine our civic space and democratic institutions. The work of the International Grand Committee has proven valuable in highlighting the issue of disinformation and desires this work to continue. The Committee continues to recognise the conflicting principles that sometimes apply to the regulation of the internet, including the aim to protect freedom of speech, in accordance with national laws, while, at the same time, countering abusive speech and disinformation. There is need for full transparency regarding the source, targeting methodology and levels of funding for all online political advertising but such controls should not be interpreted as a blanket ban on advertising relating to the political sphere. The Committee believes that global technology firms cannot on their own be responsible in combatting harmful content, hate speech and electoral interference and that self-regulation is insufficient. Technology companies should be fully accountable and answerable to national legislatures and other organs of representative democracy. The internet is global and accordingly it is vital that an internationally collaborative approach is taken with regard to regulation. The Committee recognises the initiatives taken by individual countries and non-governmental organisations in this space, but these require more co-ordination across national boundaries.The Committee therefore recognises the need for a dedicated international space which provides such co-ordination of internet regulations and commit to work with governments and relevant multilateral organisations in the establishment of such governance structures. Political advertising on social and traditional media is being investigated by the Joint Standing Committee on Electoral Matters as part of its inquiry into the 2019 Federal election. Committee Chair, Senator James McGrath, said social media has blurred the lines of what is and isn’t political advertising. ‘It was clear in the 2019 election that Australians were inundated with a huge volume of political advertising on all platforms. But perhaps of more concern is the rise in political disinformation from ambiguous sources online,’ the Senator said. ‘Smart phones and social media have changed how Australians publish and access information. Digital platforms are taking over traditional media – but the regulatory framework hasn’t kept up.’ ‘Electoral integrity is crucial for a healthy democracy. We need to hear from people with solid ideas on how we can keep our electoral processes strong.’ Anybody can make a submission that address the terms of reference.
