Overall Conclusion

The Committee is satisfied that appropriate processes have been followed and concludes that Hizballah’s External Security Organisation continues to meet the definition of a terrorist organisation, namely that the organisation:
Is directly or indirectly engaged in, preparing, planning assisting in or fostering the doing of a terrorist act; or
Advocates the doing of a terrorist act.
The Committee therefore supports the re-listing of this organisation under the Criminal Code and finds no reason to disallow the legislative instrument.
However, the Committee has made recommendations regarding expanding the listing of Hizballah.

About this inquiry

On 11 May 2021 the Parliamentary Joint Committee on Intelligence and Security commenced a review of the relisting of Hizballah's External Security Organisation as a terrorist organisation under the Criminal Code Act 1995.

Section 102.1 of the Criminal Code Act 1995 provides that the Committee may review a regulation which lists an organisation as a terrorist organisation and report its comments and recommendations to each House of the Parliament before the end of the applicable disallowance period for the House. The disallowance period is 15 sitting days from the day the regulation is tabled.
