Reasons of the House of Representatives for disagreeing to the amendments of the Senate

The House of Representatives considers that the settings in Schedule 1 to the Bill (as transmitted to the Senate) properly implement the 2023-24 Budget measure to increase the instant asset write-off threshold to $20,000 until 30 June 2024, and provide appropriate, fiscally and economically responsible, support to small businesses.
To prevent any delay in small businesses getting these promised tax benefits as part of Tax Time 2024, the House of Representatives does not agree to these amendments.

On the motion of Mr Jones, the reasons were adopted.

“whilst not declining to give the bill a second reading, the House:

(1)criticises the Government for failing to control the illicit vaping market and failing to protect children against the proliferation of vaping products that have exploded in availability through a black market driven by organised crime;

(2)expresses its alarm that the current prescription-only model is failing, with only approximately 10 per cent of vapers purchasing their product legally through prescriptions;

(3)acknowledges the existence and strength of the $1 billion black market vape trade in Australia, which is fuelled by the importation of more than 100 million illicit disposable devices each year;

(4)recognises that resourcing of enforcement measures at the borders and the point of sale has been grossly insufficient and that policy measures such as prohibition have historically not worked;

(5)calls on the Government to consider all policies to prevent children from accessing and becoming addicted to vaping products; and

(6)further criticises the Government for failing to establish or fund its promised illicit tobacco and vaping commissioner”—

“the House:

(1) notes that the inclusion of unrealised capital gains in the measurement of earnings will:

(a) add further complexity, red tape, and costs to the superannuation legislative framework;

(b) lead to unintended consequences that contradict the stated objective of the bill;

(d) risk substantial liquidity stress and financial stress for members of self-managed super funds;

(e) constitute a significant departure from the long-established principles of our tax system; and

(2) calls on the Government to replace the current measurement of earnings with a simplified measurement that reduces uncertainty and the severity of including unrealised capital gains, such as using a deemed rate of return (adjusted for unrealised gains) as a proxy for earnings”
